ONLINE SALE GENERAL CONDITIONS
This document lists and describes the terms and conditions of sale between the company BEON s.r.l., with registered offices in Zona Industriale, 8 – 66034 Lanciano (CH), VAT number 0258452069, hereinafter referred to as ‘BEON’, and any natural or legal person, hereinafter referred to as ‘CUSTOMER’, purchasing online on the website www.beonhealth.it
These conditions may be subject to changes. Such amendments coming into force from the moment of their publication on the website. These terms govern the purchases made on the www.beonhealth.it site in accordance with the provisions of Part III, Title III, Chapter I, of the Consumption Code, L. D. no. 206/2005, as amended by L. D. n. 21/2014 and L. D. 70/2003 on e- commerce.
ARTICLE 1 – Subject of the Contract
By these general sales conditions, the CUSTOMER makes distance purchases of movable tangible assets which are shown and offered on sale by BEON on the website www.beonhealth.it. The contract is concluded exclusively via the Internet, when the CUSTOMER accesses the www.beonhealth.it site and made a purchase order according to the procedure provided by the site itself. Prior to confirming their order, the CUSTOMER agrees to view these general sales conditions, in particular the pre-contractual information provided by BEON, and to accept them by flagging the indicated box. In the order confirmation e-mail, the CUSTOMER will also receive the link to download and store a copy of these general sales conditions, as provided for in art. 51 paragraph 1 of L. D. 206/2005, as amended by L. D. 21/2014.
ARTICLE 2 – Pre-contractual Information for the Consumer – art. 49 of L. D. 206/2005
Before the conclusion of the purchase contract, the CUSTOMER will examine the characteristics of the goods which are shown in the individual product data sheet at the moment of their purchase choice.
Before the conclusion of the purchase contract, and prior to the validation of the order, the CUSTOMER will be informed of:
– the total price of the goods, including taxes, with the details of the shipping costs and any other costs;
– payment methods;
– conditions, terms and procedures for the withdrawal right (Article 6 of these Conditions) as well as the withdrawal form set out in Annex I, Part B of L. D. 21/2014;
– the cost to return the goods in case of the CUSTOMER’s withdrawal

ARTICLE 3 – Conclusion and Effectiveness of the Contract
The sales contract is considered concluded when the CUSTOMER is sent an order confirmation email by BEON containing the CUSTOMER’s data, the order number, the price of the purchased goods, the shipping costs and the delivery address to which the goods will be sent to. The CUSTOMER will both verify the personal data contained therein and promptly inform BEON of any amendments. BEON will fully describe and present articles sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the site and the actual product may appear. In addition, the photos of the products presented on www.beonhealth.it do not constitute part of the contract as they are only representative.
BEON will deliver the goods within 3-4 days after the CUSTOMER is sent an order confirmation email. However, some delays may occur in the delivery due to any inaccuracies between the site and the real stock availability. In such cases, the customer is notified by telephone or email, and they will decide whether to cancel the order or wait for the supply.
ARTICLE 4 – Products Availability
Products availability means the actual availability when the CUSTOMER places an order. However, it must be considered merely indicative because, due to the simultaneous presence of multiple users on the site, the products might be sold to any other CUSTOMERS before the order confirmation. There may be cases of partial or total unavailability of the goods, even after the order confirmation email sent by BEON. In this case, the order will be automatically adjusted by deleting the unavailable product and the CUSTOMER will be immediately informed by email or telephone. If the CUSTOMER requests the order to be cancelled by closing the contract, BEON will refund the amount paid within 14 days from the date BEON is informed of the CUSTOMER’S decision to terminate the contract.
ARTICLE 5 – Payment Methods
The CUSTOMER can make any payment only through the following methods • Bank Transfer • Paypal • cash on delivery. In case of payment with Paypal, the CUSTOMER will be charged for the product as soon as they will be sent the order confirmation email by BEON. The communications regarding the Payment and the data provided by the CUSTOMER at the moment of the order placement, will take place on special protected lines. The security of the payment through Paypal is guaranteed by this means of payment, as BEON will never be aware of any CUSTOMER’s credit card details.
ARTICLE 6 – Prices
All sales prices of the products listed on www.beonhealth.it are expressed in Euro and include VAT. Shipping costs are not included in the purchase price but are indicated and calculated at the time of the purchase process, before the payment is made. The CUSTOMER accepts BEON’s faculty of modifying its prices at any time, but the goods will be invoiced based on the prices indicated on the site, at the time of the order placement, and in the confirmation email sent by BEON to the CUSTOMER. In the event of a computer, manual, technical, or any other error not foreseen by BEON, which may cause a substantial change of the selling price to the public, making it extremely high or low, the purchase order will be considered invalid and cancelled, and the amount paid by the CUSTOMER will be refunded within 14 days from the day of the cancellation.
ARTICLE 7 – Right of Withdrawal
In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products. Should the CUSTOMER wish to withdraw, BEON must be informed through a direct email which can be sent to firstname.lastname@example.org by writing ‘WITHDRAWAL REQUEST’ in the object. In such a case the CUSTOMER is required to return the goods within 14 days from the date BEON is notified of the CUSTOMER’S intention to withdraw from the contract, pursuant to Art. 57 of L. D.206/2005. The goods must be returned to BEON S.R.L., Zona Industriale 8, 66034, Lanciano (Ch). The direct costs of the returned products have to be borne by the CUSTOMER. The goods must be returned intact, in the original packaging and still sealed. Once BEON has verified that all the aforementioned conditions have not failed to comply, the company will refund the amount of the products returned within of 14 days, including any shipping costs. As foreseen by art. 56 paragraph 3 of L. D. 206/2005, amended by L. D. 21/2014, BEON may suspend the repayment until the receipt of the goods, or until the CUSTOMER has demonstrated that they have returned the goods to BEON. BEON will make a refund using the same payment method chosen by the CUSTOMER during the purchase. In the case of payment made through a bank transfer, and should the CUSTOMER wish to withdraw, they will have to inform BEON of their bank details: IBAN, SWIFT and BIC required for the repayment.
ARTICLE 8 – Legal Compliance Guarantee
Should the CUSTOMER receive faulty products or different from the order, they will be entitled to have them replaced without any extra costs. BEON will arrange the faulty or different products to be collected according to the CUSTOMER’s availability.
ARTICLE 9 – Delivery Methods
The products will be delivered by express courier (GLS, Bartolini, FedEx, etc.) to the address indicated by the CUSTOMER at the time of order, within and not over 30 days from the date they are sent the order confirmation e-mail by BEON. For each order placed on the www.beonhealth.it site, BEON issues an invoice of the goods shipped, containing all the information provided by the CUSTOMER during the purchase procedure. Once the invoice is issued, you will not be able to make any changes to the data shown in it.
ARTICLE 10 – Liability
As regards the order within the terms of the contract, BEON assumes no liability for any disruption due to force majeure or fortuitous incidents, even if it is affected by malfunctions and disruption of the Internet.
ARTICLE 11 – Access to the Site
The CUSTOMER has the right to access the site for consultation and purchase. No other use of the site or its contents, especially commercial, is permitted. The integrity of both visual and sound elements of this site, and the related technology remain BEON’s property and are protected by intellectual property law.
ARTICLE 12 – Cookies
The website www.beonhealth.it can use ‘cookies’. Cookies are electronic files that record any CUSTOMER’s browsing information on the site (pages visited, date and time of consultation, etc.) and allow BEON to offer a customized service to its CUSTOMERS. BEON informs the CUSTOMER of the possibility of deactivating the creation of such files by accessing their own Internet Configuration menu. It is implied that this will prevent the CUSTOMER from proceeding with the online purchase.
ARTICLE 13 – Integrity
These General Terms and Conditions of Sale are made up of all the clauses that form them. Should one or more of the provisions of these General Terms and Conditions of Sale be considered invalid in accordance with the Law, regulation or decision of a court having jurisdiction, the other provisions will continue to be fully effective.
ARTICLE 14 – Applicable Law and Competent Jurisdiction
These General Conditions of Sale are subject to Italian Law. Any dispute that does not find a friendly solution will be subject to the exclusive jurisdiction of the Court of the CUSTOMER’s place of residence or domicile, when located in the territory of the State. In any case, it is possible to use the mediation procedures provided for in L. D.28/2010, for the resolution of any disputes arising in the interpretation and execution of these sales conditions.
